Is Emulating GBA roms legal?
YES - Despite false claims by Nintendo that emulation as such
is illegal they (Nintendo Of America Ltd.) have registered a US
Patent for GAMEBOY EMULATOR (look here -
US Patent N# 6,672,963
) so
proving themselves wrong and making any claims about emulation being illegal
have NO credibility. You can not get a patent for something that is illegal.
What is a Nintendo Game Boy Emulator?
A Nintendo GameBoy emulator is a software program that is designed
to allow game play on a platform that it was not created for.
GBA emulator allows for Nintendo console games to be played on
"unauthorized" hardware. The video games are obtained by downloading
GBA ROMs from Internet distributors. Nintendo ROMs then work with
the Nintendo emulator to enable game play on unauthorized hardware
such as a personal computer Mac, PC, Linux, a modified console,
etc.

GBA ROM ("Read Only Memory") is the type of chip used
in Nintendo's video game cartridge which contains the game software.
However, this term is commonly used on many gaming sites on the
Internet and refers to game data that has been
copied / backuped from an authentic Nintendo Gameboy Advance
/ GBA SP video game cartridge.

Commercial roms - YES - downloading / sharing / distributing

Freeware and Public Domain (PD) ROMS are not made by NINTENDO
or its partners and they are LEGAL.
In most cases they are made as freeware, shareware or demos
and
legalized for free use by their authors. It is 100% legal for people play such
roms on emulators or gba flash cards.

commercial GBA ROMS?
NO - And we will never do it as it is illegal.
USA is not the only country in the world and US law works only
in the United States of America and nowhere else. Many countries
in the world have their own specific copyright laws so you can
look on the internet to find sites that are involved in distributing
gba roms - that would be illegal in US but could have no
laws against in their country.
